1. The 8agora Platform

8agora is an interactive spatial computing platform that may provide virtual environments, 3D content, avatars, collaboration tools, multimedia, connected data, demonstrations and other interactive functionality.

Certain parts of the platform may be experimental, demonstrational or under continuous development. Features may therefore be added, modified, suspended or removed as the platform evolves.

The platform and services are provided on an "as is" and "as available" basis. We do not guarantee that every feature will operate without interruption or error at all times.

2. License and Permitted Use

Subject to these Terms, Impro Media grants you a limited, non-exclusive, non-transferable and revocable right to access and use the 8agora platform for its intended purposes.

This permission does not transfer ownership of the platform, its software, technology, interface or proprietary content to you.

You may not provide unauthorized access to your account or make the platform available to third parties except where expressly permitted by Impro Media.

3. Accounts and User Access

Where an account is required, you are responsible for maintaining the confidentiality of your account credentials and for activities performed through your account.

You must promptly notify us if you become aware of unauthorized use of your account or any other security breach.

You may not use a username, identity or email address that you are not legally entitled to use, or impersonate another individual or entity.

Unless expressly stated otherwise for a particular environment or service, users must be at least 18 years old to create and use an individual 8agora account.

Certain demonstration environments may allow the use of nicknames, aliases and customized avatars. The use of an avatar or alias does not exempt you from these Terms.

4. Shared Virtual Environments and Recordings

Some 8agora environments are collaborative spaces in which other users may be present and may be able to see, hear or otherwise interact with you or your avatar.

You should not disclose confidential, sensitive or personal information in shared environments unless you have determined that doing so is appropriate and permitted.

Recording, capturing or distributing another user's voice, image, avatar, communications or activities must comply with applicable law and the rights of the persons concerned.

Where recording functionality is available, you are responsible for obtaining any consent required before recording or distributing content involving other participants.

5. Prohibited Use

You agree not to use 8agora:

1. In violation of applicable national, European Union or international law.
2. To infringe copyright, trademark, privacy, publicity or other rights belonging to Impro Media or any third party.
3. To exploit, threaten, harass, defraud or harm another person.
4. To distribute spam, unauthorized advertising, malicious messages or unlawful promotional material.
5. To impersonate Impro Media, an Impro Media representative, another user or another person or organization.
6. To interfere with another user's lawful use of the platform.

You also agree not to:

1. Disable, overload, damage or interfere with the operation of the platform.
2. Attempt to gain unauthorized access to accounts, systems, servers, networks or databases associated with the platform.
3. Introduce viruses, malware, harmful code or other malicious technology.
4. Use automated systems to scrape, extract or copy platform content without authorization, except where permitted by applicable law.
5. Sell, rent, sublicense, distribute or otherwise make the platform or access credentials available to third parties without authorization.
6. Reverse engineer, decompile, circumvent technical protection measures or otherwise attempt to derive proprietary source code except to the extent such restriction is prohibited by applicable law.
7. Carry out denial-of-service attacks or otherwise deliberately disrupt the platform or its infrastructure.

6. Intellectual Property

The 8agora platform, including its proprietary software, interfaces, visual identity, platform-specific functionality and original materials owned or licensed by Impro Media, is protected by applicable intellectual property laws.

Nothing in these Terms grants you ownership of any intellectual property belonging to Impro Media or its licensors.

Third-party trademarks, software, media, 3D assets, services or other materials remain the property of their respective owners and may be subject to separate terms and licenses.

7. User Content

Where 8agora allows you to upload, display, transmit or otherwise make available text, images, audio, video, 3D models, documents or other material ("User Content"), you remain responsible for that content.

You represent that you own or otherwise have the necessary rights and permissions to use and provide your User Content through the platform.

You retain ownership of your User Content. To the extent technically necessary to operate the service, you grant Impro Media a limited, non-exclusive license to host, process, reproduce and display that content solely for providing the relevant 8agora functionality to you and authorized users.

You may not upload or distribute content that infringes intellectual property, privacy, confidentiality or other legal rights.

8. Third-Party Services and Links

8agora may contain or interact with third-party websites, software, platforms, media, APIs or other services that are not controlled by Impro Media.

Impro Media is not responsible for the content, availability, security or privacy practices of third-party services. Your use of such services may be governed by separate terms and privacy policies.

9. Availability, Errors and Feedback

The operation of 8agora may depend on internet connectivity, cloud infrastructure, browsers, devices, operating systems and third-party software or services.

We will make reasonable efforts to maintain the platform and address significant technical problems, but we do not guarantee uninterrupted availability.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, 8agora and its services are provided on an "as is" and "as available" basis.

Impro Media makes no guarantee that the platform will always be uninterrupted, error-free, secure or suitable for every particular purpose, or that every defect will be corrected immediately.

Nothing in these Terms excludes any warranty, right or protection that cannot lawfully be excluded under applicable law.

11. Limitation of Liability

To the extent permitted by applicable law, Impro Media shall not be liable for indirect, incidental, special or consequential losses arising solely from the use of, or inability to use, the platform.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.

12. Suspension and Termination

We may suspend or terminate access to the platform where reasonably necessary to protect the platform, other users, our systems or legal rights, or where a user materially violates these Terms.

We may also discontinue particular demonstration environments, features or services as the platform evolves.

13. Privacy

The processing of personal data associated with the 8agora website and platform is described in our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of Romania and applicable European Union law, without prejudice to any mandatory rights that may apply to you under applicable law.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in effect.

15. Changes to the Platform

We may modify, update, suspend or discontinue features or services as 8agora develops. Where appropriate, material changes affecting users will be communicated through the website, platform or other reasonable means.

16. Changes to These Terms

We may update these Terms from time to time. The current version will be published on this page together with the date of the latest update.

Your continued use of the platform after updated Terms become effective constitutes acceptance of the revised Terms where permitted by applicable law.
